{"id":6938,"date":"2017-02-14T22:58:20","date_gmt":"2017-02-14T21:58:20","guid":{"rendered":"https:\/\/truckonline.de\/blog\/?p=6938"},"modified":"2017-02-15T07:15:13","modified_gmt":"2017-02-15T06:15:13","slug":"kase-aus-holland","status":"publish","type":"post","link":"https:\/\/truckonline.de\/blog\/2017\/02\/14\/kase-aus-holland\/","title":{"rendered":"K\u00e4se aus Holland"},"content":{"rendered":"<p>Weil Lkw-Kabinen so kuschelig sind, will die niederl\u00e4ndische Verkehrsministerin <em>Melanie Schultz von Haegen<\/em> zun\u00e4chst kein Gesetz auf den Weg bringen, welches das Verbringen der <strong>Wochenendruhezeiten<\/strong> von Lkw-Fahrern in ihren Fahrerkabinen verbietet.<br \/>\nAu\u00dferdem erm\u00f6gliche das Schlafen im Lkw  den Fahrern, die Ladung besser zu bewachen, als wenn sie in einem Hotel oder einer anderen Unterkunft ihre Ruhezeit verbringen w\u00fcrden.<\/p>\n<p>Ich glaube, die hat zu viele K\u00e4sekr\u00fcmel geraucht. Nat\u00fcrlich k\u00f6nnen Lkw-Kabinen komfortabel sein. Aber darum geht es doch \u00fcberhaupt nicht&#8230;<\/p>\n<p>&#8230;sondern darum das <strong>Unternehmer gezwungen<\/strong> werden sollen, ihre Fahrer  nach Hause zu holen und die nicht \u00fcber Monate hinweg im Lkw kampieren zu lassen. Aber das wei\u00df die nat\u00fcrlich. Da haben Lobbyisten wieder ganze Arbeit geleistet. <\/p>\n<p>Dazu das Argument mit dem Bewachen der Ladung. Hat die noch alle Klompen im Schrank?<br \/>\nWer was klauen will, soll sich bedienen. Ich spiele bestimmt nicht den Helden und lass mir mit einer <strong>Eisenstange<\/strong> eine \u00fcbern Sch\u00e4del ziehen. Abgesehen davon z\u00e4hlt das als Arbeitszeit. Schl\u00fcpft ein bulgarischer Trucker Sonntagfr\u00fch um halb drei in seine Jogginghose, um seinen Auflieger zu begutachten, hat der seinen Tachographen auf Arbeitszeit zu stellen. Nach seinem Rundgang kann er wieder auf Pause dr\u00fccken. Nur dumm, dass danach seine 45-Stunden Wochenruhezeit von vorne beginnt. Also dumm zumindest f\u00fcr seinen Arbeitgeber. <\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/truckonline.de\/blog\/wp-content\/uploads\/2017\/02\/IMG_20170215_071342.jpg\" alt=\"Lkw Fahrer macht Ruhepause\" width=\"550\" height=\"308\" class=\"aligncenter size-full wp-image-6942\" \/><\/p>\n<p>Aber der Fairness halber sollte ich auch erw\u00e4hnen, dass die Ministerin der Meinung ist, die EU-Vorschriften zu diesem Problem seien noch nicht eindeutig und eine L\u00f6sung sollte EU-weit einheitlich erfolgen.<br \/>\nGenau das ist aber in Vorbereitung. In der &#8222;Verkehrsrundschau&#8220; <a href=\"https:\/\/www.verkehrsrundschau.de\/eugh-generalanwalt-ruhezeit-im-lkw-ist-rechtswidrig-1879094.html\" target=\"_blank\">lese ich heute<\/a> folgendes:<\/p>\n<blockquote><p>Der Generalanwalt des Europ\u00e4ischen Gerichtshofs (EuGH) hat das Verbringen der Ruhezeiten von Lkw-Fahrern in ihren Fahrzeugen als rechtswidrig bewertet. Das EU-Recht erlaube solche Praktiken nicht, schreibt der Generalanwalt in seinen Schlussantr\u00e4gen zu einer Klage eines belgischen Transportunternehmens gegen den belgischen Staat. Ma\u00dfnahmen, die einzelne Staaten gegen das Verbringen der Ruhezeit in den Fahrzeugen ergriffen h\u00e4tten oder ergreifen k\u00f6nnten, seien laut des Generalanwalts vollkommen gerechtfertigt&#8230;<\/p><\/blockquote>\n<p>Das ist doch eine gute Entscheidungshilfe f\u00fcr die Ministerin aus Holland.
